Customers are requested to read the following terms carefully as the services are on the basis of their acceptance and compliance. Customers becoming our member agree that they have read, understood and accepted our terms and condition regardless of their subscription or use of services. Customers accessing our commerce house, the contents of it or using the services offered by the provider which means independent party, their franchisers, partners and affiliates. 

www.genxsportsnutrition.com website is an e-commerce portal operated by Nutrition Vision Pvt Ltd. (Hence forth Nutrition Vision Pvt Ltd is called as Gen-X) The company incorporated under the laws of India. Use of portal is conditional acceptance of all terms, conditions and notifications as may be published from time to time through multi-channel information system. Gen-X reserves the right, not to accept a guest or a member from registering on the e-commerce portal without assigning any reasons.

Service Offerings
Gen-X provides multiple-commerce services through its portal (all such services collectively termed as “Service”). Each service enables customers to purchase merchandise such as supplements and accessories and nutrition service.

Privacy Policy
Customers hereby agree that they have read and fully understood the privacy policy of www.genxsportsnutrition.com the Central Commerce house. They further consent that the conditions and contents of such privacy policy are acceptable to them. 

Member Accounts and their Security
Customers shall set their password during registration process. They are responsible for the confidentiality of the password and account information and provide full consent for all activities that occur under their account and password. They agree to immediately notify Gen-X for all unauthorized use of their password or account or other security breaches. www.genxsportsnutrition.com will be not liable for any loss or damage arising from their failure to comply with this sub-section.

Omni channel subscription
Customers agree to be communicated by us via email, SMS, mobile application and voice-over to facilitate their navigation and shopping from the e-commerce site. www.genxsportsnutrition.com may communicate promotional offers periodically whenever required by them and whenever offered by the company.

Guest codes of conduct
Customers should not make any derogatory, inappropriate, abusive, defamatory, or indecent statements or comments about www.genxsportsnutrition.com  its partners and associates on any property owned by www.genxsportsnutrition.com

The Customers undertake to use the website and the services only for posting and uploading messages, blogs, reviews and materials that are proper. The same can be by example and not as a limitation. They agree and undertake that while using a service they will not abuse, defame, harass, stalk, threaten or otherwise violate the rights of others.

The Customers also agree not to publish or post or upload or distribute or disseminate any inappropriate, indecent, unlawful, defamatory, infringing or obscene topic, name, material or information. Uploading of files that contain virus corrupted files or similar software or programs that may damage the operation of e-commerce site or others’ computer or mobile/Smart devices in restricted.

Violating any code of conduct or other guidelines is a punishable offence. Violating any applicable laws or regulations which are in force every now and then; in or outside India is strictly prohibited. Anyone on exploitation of services, Gen-X reserves the rights to deprive customer of our payment on delivery option. Moreover, it can also refuse any of its services terminate accounts, and /or cancel an order at its own discretion including, but not limited to, if website believes that the customer’s conduct is violating applicable law or is harmful to Gen-X interest . 

Non compensatory policy
If the quality of product or service or information or other material purchased or obtained by the guest through the e-commerce site doesn’t fulfill the expectation, no compensation will be given other than the return and refund or exchange of the product. The guest can’t claim compensation for any reason including, but not limited to, any variation in the finish or appearance of the shipment or delay in delivery caused by unforeseen circumstances, special incidence, in director consequential damage of any kind, missed out discounts, issues arising out of our logistic partners or their personnel, unavailability of items, etc. Unreasonable request for compensation over and above the entitled refund will be treated as a loss to business case, Gen-X holds the rights to cancel orders and block accounts of such Customers without any prior notice.

Warranty and Representation
The Customers guarantee and certify that they are owner of the content that they submitted or authorized to do so and such content does not infringe upon the property rights, IPR and other rights.

Intellectual Property Rights
Gen-X owns all the Intellectual Property Rights to and into the website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility Models, trademarks, trade names, service marks, designs, know-how, trade secrets and inventions whether patentable or not, good-will, source code, meta tags, databases, text, content, graphics, icons and hyperlinks. Everybody acknowledges and agrees that they shall not use, reproduce or distribute any content from the website belonging to www.genxsportsnutrition.com without obtaining authorizations from Gen-X. The foregoing not withstood, it is expressly clarified that everybody will retain ownership and shall solely be responsible for any content that they provide or upload when using any service including any text, data, information, images, photographs, music, sound, video or any other material which they may upload, transmit or store when making use of our various services.

Prices for products are described on our market place and incorporated by reference. All prices are in Indian rupees. Prices, products and services may changes at Gen-X discretion. We also take care about mispricing. Despite our best efforts, a few of our items in our Catalogs are mispriced. However, we verify it as a part of our dispatch procedures. If an item’s correct price is less than our stated price, we charge the lower amount and dispatch. For the differential amount if paid in advance, we shall issue a Credit Note. In the reverse scenario, we cancel your order and notify you of the cancellation, when correct price of the product is higher than the offered price.

The Customer may be considered fraudulent on the following scenarios
If Customer fails to produce required document during payment detail verification, Misuse of another Customer’s phone / e-mail ID, Customer uses invalid e-mail and phone number, Overuse of a voucher code, Customer returns the wrong product, Customer refuses to pay for an order, Customer is involved in the snatch and run for any order 

Report Abuse
Customers are solely responsible for any material or content uploaded onto the website. Customers can be held legally liable for the contents and may be legally accountable if their contents or materials include defamatory comments or material protected by copyright, trademark, etc. Customers coming across any abuse or violation of this term please report to info@genxsportsnutrition.com

Unauthorized charges on Customer Card
If customers find charges on debit/credit cards for purchase made on www.genxsportsnutrition.com but have never created an account or signed up are requested to check with family members, friends and business associates / colleagues authorized to make purchase on their behalf. If customers are still unable to recognize the charge, they should report the unauthorized purchase within 60 days of the transaction so that Gen-X can begin an investigation.

Pilferage Claim
 When a Customer raises a complaint for partial item or partial order through Customer care:
1) The Customer is supposed to claim pilferage within 48 hours of delivery, failing which the claim will not be entertained.
2) E-mail will be sent seeking-providing multiple information/details like:

  1. Short description of case or situation
  2. Snapshot of package and other box
  3. Refund for prepaid orders will be done after investigation which usually requires 8-10 business days. The process includes investigation with concerned department.

3) The customer may not be liable for a refund if the below is not followed:

  1. Customer fails to provide satisfactory scenarios about the case
  2. Customer fails to provide snapshots
  3. If open delivery is received, claims must be made on the same day
  4. Customers must not dispose packaging for 3-4 days after delivery as www.genxsportsnutrition.com might need to pick-up the packaging for investigation at their end

Customer agree to indemnify, defend and hold harmless www.genxsportsnutrition.com from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by www.genxsportsnutrition.com that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to these Terms. 

If any provision of the Terms is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of these Terms shall continue to be in full force and effect.

Title and risk of loss for all products ordered by customer shall pass on to him upon www.genxsportsnutrition.com’s shipment to the shipping carrier.

Gen-X will make a maximum of three attempts to deliver your order. In case the customer is not reachable or does not accept delivery of products in these attempts Gen-X reserves the right to cancel the order(s) at its discretion.

An estimated delivery time shall be 4-6 days from date of order. On placing your order, you will receive an email containing a summary of the order and also the estimated delivery time to your location.
Sometimes, delivery may take longer due to

  1. Bad weather
  2. Flight delays
  3. Political disruptions
  4. Other unforeseen circumstances

In such cases, we will proactively reach out to you. Please check your emails and SMS regularly for such updates.
Also, we will not be able to compensate for any mental agony caused due to delay in delivery. The customer can cancel the order at any moment of time even if the delivery time exceeds the expected delivery time. If it is a prepaid order, the customer will be refunded back in the account as soon as the order is successfully cancelled.

"The Buyer agrees that the title to the goods is transferred to the buyer at the time of placing the Order and dispatch confirmation thereof irrespective of Shipping of Goods and POD which are to be done in due course being separate chargeable facilities"

Post Delivery
Returns and Exchange conditions:
www.genxsportsnutrition.com will accept Return or Exchange only if the following conditions are met.

  1. Return/Exchange should be initiated within 14 days of order delivery.
  2. The tags on the product should be intact.
  3. The product should be unwashed, unused and in an undamaged condition.
  4. The item needs to be returned along with the original packaging.

Limitation on refund amount for courier charges
If the customer wants to instant return or return within 15 days from delivery date, and Gen-X does offer reverse pickup of the items, the customer can send us the shipment himself/herself as well. Also, we request the customer to send the scanned copy of the courier slip to sales@genxsportsnutrition.comand Gen-X will issue Credit Note.

Reverse Pickup Process:
Gen-X will not be liable for the products returned by mistake
In a scenario where a product not belonging to Gen-X is returned by mistake, Gen-X is not accountable for misplacement of the product and is not responsible for its delivery back to the customer.

In case of exchange request placed by the customer, the exchange will be done on special price of the item(s) not on MRP.

  1. Gen-X may suspend or terminate your use of the Website or any Service if it believes, in its sole and absolute discretion that you have breached any of the Terms.
  2. If you or Gen-X terminates your use of the Website or any Service, www.genxsportsnutrition.com  may delete any content or other materials relating to your use of the Service and Gen-X will have no liability to you or any third party for doing so.
  3. You shall be liable to pay for any Service or product that you have already ordered till the time of Termination by either party whatsoever. Further, you shall be entitled to your royalty payments as per the User License Agreement that has or is legally deemed accrued to you.

Governing Law:
These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Mumbai.
